Terms of Use

1. Purpose

These Terms of Use (hereinafter "ToU") govern access to and use of the B2B Finance CRM platform (hereinafter "the Platform" or "the Service") published by Alforis Finance.

Use of the Platform implies full and complete acceptance of these ToU. If you do not accept these terms, please do not use the Service.

2. Definitions

• User: Any natural or legal person accessing and using the Platform
• Client: Any legal entity that has subscribed to a paid subscription
• Administrator: User with administration rights within an organization
• Data: All information entered, generated or enriched via the Platform
• AI Services: Automatic enrichment features using artificial intelligence

3. Service Access

3.1 Registration

Access to the Platform requires the creation of a user account. During registration, you agree to provide accurate, complete and up-to-date information.

You are responsible for the confidentiality of your login credentials and all activity from your account.

3.2 Trial Period

A free 14-day trial is offered with no commitment and no credit card required. At the end of this period, you will need to subscribe to a paid plan to continue using the Service.

3.3 Availability

We strive to keep the Platform accessible 24/7, subject to scheduled maintenance operations. We reserve the right to temporarily interrupt access for technical or security reasons.

4. Service Usage

4.1 Authorized Use

The Platform is intended for professional use in customer relationship management. You agree to:

• Use the Service in accordance with applicable laws and regulations
• Comply with GDPR and the rights of data subjects
• Not use the Service for illegal or fraudulent purposes
• Not attempt to circumvent security measures
• Not harm the integrity of the Platform

4.2 Prohibited Uses

It is strictly prohibited to:

• Resell, rent or redistribute access to the Service
• Engage in reverse engineering
• Collect data automatically (scraping, crawling)
• Use the Service to send spam or malicious content
• Share your credentials with unauthorized third parties

5. Intellectual Property

5.1 Platform Ownership

The Platform, its source code, interface, algorithms and all associated documentation are the exclusive property of Alforis Finance and are protected by copyright and intellectual property rights.

5.2 Data Ownership

You retain full ownership of your data. We only use your data to provide the Service and in accordance with our Privacy Policy.

6. Artificial Intelligence Services

6.1 Operation

AI Services enable automatic data enrichment using artificial intelligence models and public data sources.

6.2 Accuracy and Reliability

AI-enriched data is provided for informational purposes. We strive to ensure accuracy but do not guarantee 100% precision. You are responsible for verifying critical information.

6.3 Enrichment Quotas

Depending on your subscription plan, monthly enrichment quotas apply:

• Starter: 500 enriched contacts/month
• Professional: 2,000 enriched contacts/month
• Enterprise: Unlimited (subject to contractual agreement)

7. Pricing and Payment

7.1 Prices

Prices are indicated in euros (EUR) excluding taxes and are subject to change. Any price change will be notified 30 days before its application.

7.2 Payment Methods

Subscriptions are payable monthly or annually by credit card via Stripe. Payment is automatically debited at each due date.

7.3 Payment Default

In case of payment default, access to the Service may be suspended after a 7-day period and an email reminder.

8. Termination

8.1 Termination by Client

You can terminate your subscription at any time from your client area. Termination will take effect at the end of the current subscription period, without pro-rata refund.

8.2 Termination by Alforis Finance

We reserve the right to suspend or terminate your account in case of violation of these ToU, with 7 days notice except in case of serious breach.

8.3 Data Recovery

After termination, you have 30 days to export your data. After this period, data will be permanently deleted.

9. Liability and Warranties

9.1 Warranties

We guarantee that the Service will be provided with reasonable care and in accordance with professional standards. We aim for 99.5% availability (excluding scheduled maintenance).

9.2 Limitation of Liability

Our liability is limited to direct and foreseeable damages, up to the amount of your annual subscription. We cannot be held responsible for:

• Data loss caused by your actions
• Your use of enriched data
• Service interruptions due to external causes (force majeure, DDoS attacks, etc.)
• Indirect damages (loss of revenue, customers, etc.)

10. Data Protection (GDPR)

As data controller, you agree to use the Service in compliance with GDPR. Alforis Finance acts as processor and commits to:

• Process data only according to your instructions
• Ensure data security (AES-256 encryption)
• Assist in responding to data subject requests
• Notify any data breach within 72 hours
• Host data exclusively in the European Union

11. ToU Modifications

We reserve the right to modify these ToU at any time. Substantial modifications will be notified by email 30 days before coming into effect.

Continued use of the Service after the new ToU come into effect constitutes acceptance thereof.

12. Applicable Law and Jurisdiction

These ToU are governed by French law. In case of dispute, the parties will endeavor to find an amicable solution before any legal action.

Failing amicable agreement within 60 days, any dispute relating to these ToU will be submitted to the exclusive jurisdiction of the Paris courts.
